1. General Provisions
These General Terms and Conditions apply to all offers, orders, and agreements between SAKURA GROUP SRL, trading as SAKURION (hereinafter "SAKURION"), and its clients (hereinafter "the Client"). By placing an order or booking a service, the Client expressly accepts these Terms and Conditions. Any derogation must be agreed upon in writing.
2. Services and Products
SAKURION provides professional aesthetic technology devices, skincare products, training programs through SAKURION Academy, and aesthetic treatments through SAKURION Clinic. All services and products are delivered in accordance with applicable Belgian and European regulations.
3. Pricing and Payment
All prices are quoted in euros and are exclusive of VAT unless stated otherwise. Invoices are payable within twenty-one (21) working days unless another payment timeframe is specified on the invoice or order. In the event of non-payment by the due date, SAKURION reserves the right to request a fixed interest payment amounting to 10% of the outstanding sum. SAKURION is authorised to suspend any provision of services without prior warning in the event of late payment.
4. Late Payment
If a payment remains outstanding more than sixty (60) days after the due payment date, SAKURION reserves the right to engage a debt recovery company. All legal expenses incurred shall be payable by the Client.
5. Withholding Tax
Certain countries may apply withholding tax at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source shall be paid by the Client to the relevant tax authorities. Under no circumstances can SAKURION become involved in costs related to a country's legislation. The amount of the invoice will therefore be due to SAKURION in its entirety.
6. Delivery and Performance
SAKURION undertakes to deliver products and perform services in due time in accordance with agreed timeframes. However, none of its obligations can be considered as an obligation to achieve results. Delivery dates are indicative and not binding unless expressly agreed in writing.
7. Device Warranty
All SAKURION professional devices come with a two (2) year warranty covering manufacturing defects. The warranty does not cover damage caused by misuse, unauthorised modifications, or failure to follow operating instructions provided during SAKURION Academy training.
8. Training and Certification
SAKURION Academy training programs are subject to separate enrolment terms. Certifications are awarded upon successful completion of the relevant program. SAKURION reserves the right to modify training content to reflect the latest industry standards and technological developments.
9. Clinic Treatments
All aesthetic treatments performed at SAKURION Clinic are subject to a prior consultation. Results may vary between individuals. SAKURION Clinic cannot guarantee specific outcomes. Cancellations must be made at least 24 hours before the scheduled appointment.
10. Complaints
Any claim must be notified to SAKURION by means of a letter sent by recorded delivery to its registered office within eight (8) days of the delivery of goods or the provision of services.
11. Liability
SAKURION shall not be held liable for any indirect, incidental, or consequential damages. SAKURION's total liability shall in no event exceed the amount paid by the Client for the specific product or service giving rise to the claim.
12. Data Protection
SAKURION processes personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian data protection legislation. For more information, please refer to our Privacy Policy available at sakurion.odoo.com/privacy.
13. Governing Law and Jurisdiction
All contractual relations shall be governed exclusively by Belgian law. Any disputes arising from or in connection with these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium.
